Welcome to GrowthArc ("Company", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and services (collectively, the "Platform").
By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Platform.
Important: GrowthArc is a coaching platform that connects coaches with clients. We are NOT a licensed therapy, counseling, or healthcare provider. See Section 12 for important disclaimers.
GrowthArc provides a software platform that enables:
You must be at least 18 years old to use the Platform. By using GrowthArc, you represent and warrant that you meet this age requirement.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
Access to the Platform requires a paid subscription. Plans start at $150 per month for coach accounts. There is no free trial: a valid payment method and an active subscription are required before you can use the Platform. You may cancel at any time, and access continues until the end of the billing period you have already paid for.
Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can cancel anytime through your account settings.
Refunds for coaching sessions are governed by the individual coach's cancellation policy. Coaches set their own cancellation and refund policies which are displayed before booking.
To request a refund, contact us at support@growtharc.com with your account details and reason for the request. Refunds are processed within 5-10 business days.
By registering as a coach, you represent that you:
The relationship between coaches and clients is direct. GrowthArc is not a party to this relationship. Coaches are solely responsible for:
Coaches using GrowthArc are independent contractors, not employees. Coaches are responsible for their own taxes, insurance, and business compliance.
As a client, you agree to:
Clients are responsible for selecting a coach that meets their needs. GrowthArc does not endorse or guarantee any specific coach's qualifications, methods, or results.
Coaches may only use client testimonials or success stories with explicit written consent from the client. The "Allow Testimonials" setting in Privacy Settings constitutes this consent.
All testimonials displayed on the Platform must be genuine and from actual clients. Coaches may not fabricate, solicit fake, or materially alter testimonials.
Testimonials must comply with FTC guidelines. If a client received any compensation, discount, or benefit for providing a testimonial, this must be disclosed.
You agree not to:
The Platform and its original content, features, and functionality are owned by GrowthArc and are protected by intellectual property laws.
You retain ownership of content you create (goals, notes, journal entries). By posting content, you grant us a limited license to display and store it as necessary to provide the Platform.
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
COACHING IS NOT THERAPY: Life coaching, wellness coaching, and similar services provided through GrowthArc are NOT substitutes for licensed therapy, counseling, psychology, psychiatry, or other mental health services. Coaches on our Platform are NOT licensed mental health professionals unless explicitly stated in their credentials.

While many clients experience positive outcomes from coaching, individual results vary. We do not guarantee any specific results, outcomes, or transformations.
AI-powered features on our Platform are tools to support the coaching process. AI cannot replace human judgment and should not be relied upon for important decisions. All AI interactions are designed to supplement, not replace, the coach-client relationship.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWTHARC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from the use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless GrowthArc and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.
We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Platform ceases immediately.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or through the Platform. Continued use after changes constitutes acceptance of the modified Terms.
These Terms shall be governed by the laws of Delaware, United States, without regard to conflict of law provisions.
Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that you may assert claims in small claims court if eligible.
